Terms and Conditions for BRIK

These Terms and Conditions ("Terms") govern the agreement between BRIK ("we," "us," "our") and the Client ("you," "your"). By signing up for any of BRIK's services, you agree to the following terms, including a minimum commitment of 12 months, as outlined below.
1. Definitions
1.1 BRIK - Refers to BRIK, the provider of web development, branding, and digital marketing services as outlined in these Terms.
1.2 Client - The individual or entity who enters into an agreement with BRIK for services.
1.3 Services - The packages and/or add-ons offered by BRIK as selected by the Client, including branding, website development, SEO, email setup, analytics, and more.
2. Service Packages and Inclusions
BRIK offers the following monthly subscription packages, each with a minimum contract period of 12 months:
Side Hustle - £299/month
Includes: unique company branding, custom domain name, 5-page website with content (500 words per page), custom email.
Entrepreneur - £599/month
Includes: unique company branding, custom domain name, 7-page website with content (500 words per page), custom email, one 2,000-word SEO blog post.
Premium Pro - £1199/month
Includes: unique company branding, custom domain name, 9-page website with content (500 words per page), three custom emails, two 2,000-word SEO blog posts, competitor analytics.
Each package is designed to include only what is stated. Any customizations outside of the standard package will require additional fees.
3. Add-Ons
Clients can enhance their package with the following add-ons, which are charged at additional rates:
- PPC for DuckDuckGo, Bing, Baidu, Yandex
- Ad production
- Blog articles
- Shopify integration
- Data analytics
- Email marketing
As an ethical operator, BRIK does not work with Google or offer social media services outside of X (formerly Twitter).
4. Minimum Contract Period
4.1 Commitment Term - All service packages have a minimum contract period of 12 months. By entering into an agreement with BRIK, the Client acknowledges and agrees to remain in contract for the full 12-month period.
4.2 Early Termination - Should the Client wish to terminate the contract before the end of the 12-month minimum period, they will be liable to pay the remaining balance for the entirety of the contract term.
4.3 Renewal - After the 12-month period, the agreement will automatically continue on a month-to-month basis unless cancelled by either party with 30 days' written notice.
5. Payment Terms
5.1 Billing Cycle - Clients are billed monthly on the anniversary date of the service initiation.
5.2 Payment Method - Payment must be made via bank transfer, credit card, or other accepted payment methods specified by BRIK.
5.3 Late Payment - Payments must be received within 14 days of the billing date. Failure to pay may result in service suspension or termination. Late fees may apply.
6. Client Responsibilities
6.1 Content and Branding Approval - The Client is responsible for providing any required content, logos, or brand guidelines in a timely manner to avoid delays in service delivery.
6.2 Compliance - The Client must ensure that all content provided to BRIK complies with applicable laws and regulations. BRIK is not responsible for verifying the legality of the content provided by the Client.
7. Service Delivery and Limitations
7.1 Scope of Service - BRIK will deliver services as outlined in the chosen package or add-on. Any requests beyond the agreed scope may incur additional charges.
7.2 Third-Party Services - BRIK is not responsible for any issues or limitations resulting from third-party platforms, including but not limited to Shopify, email providers, and PPC platforms (DuckDuckGo, Bing, Baidu, Yandex).
8. Limitation of Liability
BRIK will not be liable for any indirect, incidental, or consequential damages arising from the use of its services. Our total liability to the Client, regardless of circumstances, is limited to the amount paid by the Client in the previous 12-month period.
9. Intellectual Property
9.1 Ownership - All intellectual property rights to the content created by BRIK will remain with BRIK until the contract term is fulfilled in full, including payment of all fees.
9.2 Transfer - Upon full payment and completion of the 12-month term, intellectual property rights may be transferred to the Client upon request.
10. Confidentiality
Both parties agree to keep confidential all proprietary information disclosed during the course of this agreement. This provision will survive the termination of the contract.
11. Modifications to Terms
BRIK reserves the right to amend these Terms at any time. Clients will be notified of any significant changes, and continued use of our services after such notification constitutes acceptance of the amended Terms.
12. Termination
12.1 Cause for Termination - BRIK reserves the right to terminate the agreement for breach of these Terms, failure to pay, or any unethical or illegal actions by the Client.
12.2 Effect of Termination - Upon termination, the Client's access to all BRIK services will cease, and outstanding fees must be paid in full.
13. Governing Law
These Terms are governed by the laws of [Your Jurisdiction], without regard to its conflict of law provisions. Any disputes arising from this agreement will be settled in the courts of [Your Jurisdiction].

By agreeing to these Terms and beginning service, the Client acknowledges full understanding and acceptance of the minimum 12-month commitment, and the conditions specified.
